Belgium: new workplace air quality law

In Ukraine, air cleanliness is regulated only by the law regarding food safety in accordance with the requirements of the KHASSR.

Our company “visited” inside many ventilation systems that provide air supply both in offices, and in large shopping centers, production restaurants. And we want to state the fact that many owners are not interested in a high-quality and clean air supply. What we saw inside the ventilation systems is more like mountains of garbage, dust, mold, and in restaurants, fat is also added through which air breaks through.

Legally, the purity of air in rooms not related to food is not regulated.

Therefore, if your room is completely dependent on the air supply through the ventilation system, be prepared for the fact that the air you breathe is not clean enough. And perhaps your fatigue, frequent illnesses, allergies, is a consequence of this.

In Belgium, for example, on May 2, 2019. The Royal Decree was adopted, which amends the Code of Welfare at Work regarding indoor air quality, adding a definition of “workspace”, that is, the space in which the workplace is located. It also amends articles relating to ventilation of workplaces.

The general principle is that workers should receive good indoor air quality. Previously, only the criterion “sufficient fresh air” was taken into account. Now the employer is obliged to conduct an analysis of the risk of indoor air quality and take into account various sources of pollution: the presence and physical activity of people; availability of products and materials at the workplace; maintenance, repair and cleaning of the workplace and air quality are provided by infiltration and ventilation, pollution and operation of ventilation systems, air purification and heating.

The employer must take the necessary technical and / or organizational measures to ensure that the CO2 concentration in the workplace is usually less than 900 ppm.

Employers must prepare an action plan for existing buildings. To this should be added step-by-step planning in order to gradually improve the situation with the help of short-, medium- and long-term activities. With new construction after January 1, 2020, the rules must be respected immediately from the date of delivery.

It is possible that in Ukraine at the legislative level norms will also be fixed regarding air cleanliness not only at the workplace, but also in all rooms in which air is supplied by the supply and exhaust ventilation system.
